The New Standard for Engineering Accountability

As regulatory scrutiny increases, engineers must be able to justify the decisions they make throughout the design process. What are the three gateways to building safety?

The Building Safety Act (2022) introduced a staged approval process for higher-risk buildings, overseen by the Building Safety Regulator. This process requires projects to pass through three defined gateway points, each acting as a formal review of safety, compliance, and design intent[1][2]. The gateways are as follows:

Gateway 1 (Planning): Building safety, such as fire safety, is assessed at the planning stage, with input from the Health and Safety Executive as a statutory consultee.
Gateway 2 (Pre-construction): Construction cannot begin until the full design demonstrates compliance with building regulations and safety requirements.
Gateway 3 (Completion): The completed building must match the approved design, supported by evidence and documentation, before occupation is permitted.

If a design decision cannot be supported with evidence at any of these stages, approval can be withheld. This leaves consultants with little room for error or uncertainty.

 

What Does ‘Defensible Decision’ Mean for M&E Consultants?

A defensible engineering design decision should be grounded in current technical knowledge and be supported by documented evidence or data. In practice, good decision-making in building design requires:

Regulatory knowledge: Understanding of up-to-date building regulations and standards, and how these apply to the system being specified.
System knowledge: Enough breadth and depth of various system behaviours, benefits, and limits, and to appropriately sign off on the best system for the design.
Traceable logic: The calculation method, assumptions, and design inputs are clear and can be followed step by step through documented evidence.
Justifiable outcome: The selected solution can be explained against alternatives, showing why it meets performance, compliance, and project requirements

If one of these elements is missing, the project design decisions risk failure when under review, whether it’s due to non-compliance or an inappropriate system choice.

 

When Are Building & Engineering Decisions Challenged?

Building design decisions face formal review at multiple fixed points in a project’s lifecycle. These are scheduled checkpoints with defined evaluators who have the authority to withhold approval or require redesign. At these points, projects must provide a record of how decisions were made in line with building regulations and system performance.

Gateway 1: Planning and fire safety
Early decisions about building layout and fire safety infrastructure are reviewed by the Health & Safety Executive (HSE) before the application reaches the Local Planning Authority. Decisions made here, including life-safety systems such as sprinklers, set the baseline against which later designs are assessed[2][3].

Gateway 2: Building control approval
Before construction begins, the BSR’s multi-disciplinary team reviews the full technical design. System selections, sizing calculations, and coordination between disciplines must all be evidenced. Work cannot proceed until the submission shows how the design meets building regulations; vague or unsupported justifications can result in approval being withheld[2].

Procurement & specification
Outside the Gateway process, procurement introduces a separate layer of scrutiny. Specifications (such as pump sizing or backflow protection devices) are reviewed against cost, performance, and compliance. A consultant who understands exactly why a specification has been chosen and can explain it is in a fundamentally stronger position than one who cannot.

Gateway 3: Completion certificates
At Gateway 3, the BSR verifies that what was built matches what was approved. Every change made during construction must pass through formal Change Control. A booster specification amended during value engineering, or a backflow protection device substituted by the contractor, requires documented evidence that the change was assessed and does not compromise the safety case[2].

Handover
At handover, O&M documentation and Regulation 38 fire safety information are reviewed for completeness. Under the BSA’s ‘golden thread’ requirements, the project record is permanent evidence of how duties were discharged. A consultant’s level of exposure at this stage comes down to the quality of what they wrote down along the way.

These stages are where gaps in system knowledge or building regulations pose the biggest risk to design approval and handover. Whether a consultant can defend their specifications depends largely on the depth of their system-specific understanding, which is best gained through approved specialist training.

 

How Knowledge Gaps Create Specification and Approval Risk

Decisions most likely to fail under scrutiny are those based on incomplete or outdated knowledge, applied in good faith, but against the wrong version of a standard, or without full awareness of how regulatory requirements have changed. Simply put, indefensible designs occur when:

  • relying on outdated standards
  • applying incorrect assumptions
  • producing vague or misunderstood specifications
  • failing to provide evidence demonstrating why a decision was made

The following scenarios show how poor system-specific knowledge can ultimately result in non-compliance and performance failures:

 

Scenario 1: Non-Compliance
A consultant does not correctly identify the end-uses of a mixed-use development, assuming it will be mostly offices, when in fact at least one floor will be a medical or laboratory facility. Consequently, they misclassify the fluid category as Category 4 under the Water Supply (Water Fittings) Regulations 1999, when it should be Category 5. As a result, an inadequate backflow prevention device is selected, exposing the building to enforcement action from the local water authority.

Scenario 2: Performance Gaps
A booster system is sized using additive design margins at every calculation stage, peak flow demand, system resistance, pump duty, and installed power, each margin individually conservative but compounding to a system that is significantly oversized. When challenged, the consultant cannot produce a calculation trail that demonstrates the sizing was based on a reasoned assessment of actual demand rather than compounded conservative assumptions.

In scenarios such as these, consultants risk:

  • Application failure at Gateway 1 or 2
  • Scrutiny during procurement or handover
  • Cost and time-intensive rework during construction
  • Loss of confidence from the client or lead contractor
  • Professional exposure and legal liability

The common thread in both scenarios is the absence of specialist knowledge regarding building systems and regulations. Broad CPD programmes often omit the detailed system-specific regulations, classification criteria or sizing calculations.

No. Under the Building Safety Act 2022, dutyholder accountability is non-delegable. Appointing a specialist does not transfer your compliance obligation; oversight responsibility remains with the appointing consultant.

Consequences include Gateway approval being withheld, mandatory redesign, procurement disputes, and professional liability. In serious cases, financial exposure can reach millions.

The Engineering Council requires all registered engineers to record and maintain CPD as a condition of holding CEng or IEng status. Persistent failure to engage with CIBSE’s CPD audit process can result in removal from the Engineering Council register.

CIBSE conducts CPD audits and requires members to submit records on request. Failure to provide records without a valid reason constitutes a breach of professional conduct. Persistent non-engagement can lead to membership downgrading and removal from the Engineering Council register.

Since January 2024, CIBSE requires all members to complete at least one semi-structured CPD activity annually in Building Safety. This directly addresses the competence requirements introduced by the Building Safety Act 2022 and supports evidence of compliance with dutyholder obligations[4].
